The Land Law Firm team defended the interests of a large developer in a dispute with the State Inspection of Real estate, finding it illegal to bring to administrative responsibility for the misuse of a land plot related to construction. The decision to impose a fine in the amount of 25 million rubles was declared illegal by the courts of three instances, and the administrative offense proceedings were terminated.

During the trial, LLF lawyers managed to prove that the Inspectorate had incorrectly qualified the developer’s actions, that the report was unreliable, and that there was no offense. To strengthen the position of the lawyers, the conclusion of a construction and technical specialist was submitted to the court. In these circumstances, the court found that the contested decision contained an incorrect qualification of the offense. The unlawfulness of bringing to administrative responsibility was confirmed by the courts of appeal and cassation instances.

The Moscow City Property Department and the Moscow Government, in their demands, obliged the client to bring the building into compliance with technical documents by dismantling the controversial attached part.
