During the trial, LLF lawyers managed to prove that the Inspectorate had incorrectly qualified the developer’s actions, that the report was unreliable, and that there was no offense. To strengthen the position of the lawyers, the conclusion of a construction and technical specialist was submitted to the court. In these circumstances, the court found that the contested decision contained an incorrect qualification of the offense. The unlawfulness of bringing to administrative responsibility was confirmed by the courts of appeal and cassation instances.
